Terms of Service

1. Who these terms apply to
These terms of service (“Terms”) govern your use of Notifyed, a public safety alerting platform operated by Notifyed Limited, a company incorporated in England and Wales (company number 14310484), whose registered address is Union House, 111 New Union Street, Coventry, West Midlands, CV1 2NT, United Kingdom (“Notifyed”, “we”, “us”, “our”).
Notifyed has two kinds of users, and different sections of these Terms apply to each:
- Consumer users: members of the public who use the Notifyed mobile app to receive safety alerts. Sections 1 to 6 and 9 to 14 apply to you.
- Publisher users: individuals who hold an account on our web portal on behalf of a council, utility, emergency service, venue, or other organisation, to create or configure alerts. All sections apply to you, including section 7 (Publisher terms).
By downloading, installing, or using the Notifyed app, or by creating a Publisher account, you agree to these Terms. If you do not agree, do not use the service.
2. What Notifyed is, and what it is not
Notifyed helps you find out about public safety events relevant to your approximate area, such as power outages, flooding, and severe weather warnings, sourced from public authorities, utilities, and other organisations who choose to publish through our platform. Notifyed operates internationally, with regional data centres in the EU, the United States (FedRAMP-authorised), Asia-Pacific, and Oceania, so your data is stored in the region appropriate to your location.
Notifyed is not a substitute for official emergency services or the UK Emergency Alerts system.
- If you are in danger or need immediate help, call 999 (or the relevant emergency number for your location) or use another official emergency channel. Do not rely on Notifyed as your only source of safety information in an emergency.
- The UK’s Emergency Alerts system, operated by the government, is the official channel for the most severe, life-threatening emergencies. Notifyed is a separate, additional service and is not affiliated with, and does not replace, the Emergency Alerts system.
3. Best-efforts service; no guarantee of delivery
We work to deliver alerts as promptly and accurately as we can, but Notifyed is provided on a best-efforts basis and we cannot and do not guarantee that:
- every relevant alert will reach you;
- an alert will reach you within any particular time; or
- the content of an alert is complete, accurate, or up to date.
This is because alert delivery depends on factors outside our control, including but not limited to:
- The accuracy and timeliness of the source data. Alerts are published by third-party organisations (see section 7) or drawn from third-party data feeds. We are not responsible for errors, delays, or omissions in the underlying information supplied by those sources.
- Your device settings. Notifications may be delayed, suppressed, or blocked by settings on your device, including notification permissions, data or battery restrictions, or manual settings you or your device manufacturer have applied.
- Operating system power management. Mobile operating systems (including Android and iOS) use power-saving modes that can delay or suppress background processing and notifications, particularly when a device has been idle or is in a low-power state, for periods ranging from minutes to several hours. This is a known and documented limitation of mobile operating systems generally, not something specific to Notifyed, and it means an alert can, in some circumstances, arrive later than intended or not arrive at all.
- Network and connectivity conditions. Notifications require an active internet or mobile data connection on your device; if your device is offline, in airplane mode, or has no signal, delivery will be delayed until connectivity resumes.
Because of these limitations, you must not rely solely on Notifyed for life-safety decisions. Always maintain other means of receiving emergency information appropriate to your situation, such as local news, official government channels, or direct guidance from emergency services.
4. Limitation of liability
To the fullest extent permitted by law:
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
- Subject to the paragraph above, Notifyed is provided “as is” and “as available”, without warranties of any kind, express or implied, as to the accuracy, completeness, timeliness, or reliability of any alert or content.
- Subject to the paragraph above, we are not liable for any loss or damage arising from a delayed, missed, incomplete, or inaccurate alert, or from your reliance on the service in place of official emergency channels, whether that loss arises in contract, tort (including negligence), or otherwise.
- Nothing in these Terms is intended to exclude or limit your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable consumer protection law.
5. The free tier
Consumer use of the Notifyed app is currently provided free of charge. We may modify, restrict, or discontinue any free features, or introduce paid features, at any time. Where we make a material change that removes or significantly reduces a free feature you already rely on, we will give you reasonable advance notice where practicable, such as through the app or a notice on our website.
This section does not affect any separate paid subscription terms that may apply to Publisher organisations, which are set out in the applicable order form, subscription agreement, or plan terms.
6. Acceptable use (all users)
You must not:
- use Notifyed for any unlawful purpose, or in a way that breaches these Terms;
- attempt to interfere with, disrupt, or gain unauthorised access to Notifyed’s systems or data;
- reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent permitted by law;
- use Notifyed to harass, impersonate, or cause harm to any other person or organisation; or
- misrepresent your identity or affiliation when creating a Publisher account.
We may suspend or terminate your access if we reasonably believe you have breached these Terms.
7. Publisher terms
This section applies to Publisher users: individuals holding an account on behalf of an organisation (a council, utility, emergency service, venue, or similar body, the “Publisher Organisation”) to publish or configure alerts through the Notifyed web portal.
7.1 Responsibility for published content
The Publisher Organisation is solely responsible for the accuracy, completeness, and lawfulness of any alert, warning, or other content it publishes or configures through Notifyed (“Publisher Content”). We do not independently verify Publisher Content before it is distributed to Consumer users, other than through automated checks we may apply from time to time.
7.2 Standards for Publisher Content
Publisher Content must:
- relate to genuine public safety information relevant to the area it is targeted at;
- be accurate to the best of the Publisher Organisation’s knowledge at the time of publication, and updated or withdrawn promptly if it ceases to be accurate;
- not be used for advertising, political campaigning, or any purpose unrelated to public safety; and
- comply with all applicable law, including data protection law if the content includes personal data about identifiable individuals.
7.3 Moderation, removal, and suspension
We may, at our discretion and without liability to the Publisher Organisation:
- remove, hide, or amend any Publisher Content that we reasonably believe breaches section 7.2, is inaccurate, or could cause harm or confusion to Consumer users;
- suspend or terminate a Publisher account or organisation’s access to Notifyed for misuse, breach of these Terms, or repeated inaccurate publishing; and
- notify affected Consumer users where we consider it appropriate to do so, for example if content has been withdrawn as inaccurate.
We will act reasonably and, where practicable given the urgency of a safety concern, will try to notify the Publisher Organisation of any moderation action taken and the reason for it.
7.4 Indemnity
The Publisher Organisation agrees to indemnify and hold Notifyed harmless against any claims, losses, liabilities, and reasonable costs (including legal fees) arising from Publisher Content it submits, to the extent those claims arise from the Publisher Organisation’s breach of section 7.2 or applicable law.
7.5 Data processing
Where a Publisher Organisation’s use of Notifyed involves Notifyed processing personal data on the Publisher Organisation’s behalf or as a joint controller, the parties’ respective data protection obligations are set out in a separate data processing agreement, available on request.
7.6 Publisher account terms
- The individual creating a Publisher account confirms they are authorised to act on behalf of the Publisher Organisation.
- The Publisher Organisation is responsible for keeping its account credentials and API keys secure, and for all activity that occurs under its account.
- Any separate order form, subscription agreement, or service level agreement entered into with a Publisher Organisation takes precedence over these Terms to the extent of any conflict.
8. Merchant of record and payments
Where paid plans are offered, payments are processed by Paddle.com Market Limited, acting as merchant of record. Paddle handles billing, payment processing, and related customer support for transactions, and Paddle’s own terms and privacy policy apply to the payment process.
9. Age restriction
Notifyed is not directed at, and is not intended for use by, children under the age of 13. If you are under 13, please do not use the app. If you are a parent or guardian and believe a child under 13 is using Notifyed, please contact us so we can take appropriate action.
10. Intellectual property
Notifyed and its content (excluding Publisher Content, which remains the property of the relevant Publisher Organisation) are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may use the app and web portal only as permitted by these Terms.
11. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the service or the law. We will update the “last updated” date at the top of this page. Where a change is material, we will take reasonable steps to notify you, such as through an in-app notice, before it takes effect. Continued use of Notifyed after a change takes effect means you accept the updated Terms.
12. Termination
You may stop using Notifyed at any time by deleting the app or, for Publisher accounts, by closing your account. We may suspend or terminate your access as described in sections 6 and 7.3, or if we discontinue the service, with reasonable notice where practicable.
13. Governing law
Notifyed Limited is incorporated in England and Wales, and these Terms are governed by the law of England and Wales. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections that apply in your country of residence. If you are using Notifyed from outside the United Kingdom, you are responsible for compliance with any local laws that apply to your use.
